Terms and Conditions:

In an ideal world we wouldn't need these. However we all know that the world isn't perfect. Therefore for Marsbrook (the supplier) and yourself (the advertiser) the following represent the terms under which we provide our service, so that all parties are clear prior to commitment.
By placing an advert on a Marsbrook.com site, you acknowledge that you have read and accept these Terms and Conditions

1. Layout, Content and Site Copyright

• Marsbrook reserves the right to
  • Determine the final design, layout and navigation of the Marsbrook.com web sites.
  • To amend or edit copy, photographs, layouts or any other material supplied, should we consider it necessary
  • At our discretion to remove links to other web sites from advertising copy submitted
  • When necessary, change the address of the web site, though 30 days notice would be given in such an event and redirections put in place for a minimum of 90 days.
• Marsbrook cannot be held responsible for any loss or damage resulting from the design or positioning of the advertisement
• Marsbrook reserves the right to refuse an advert and will not be liable for the costs of doing so.
• Marsbrook owns the copyright of any photograph it takes and interactive layout it designs and these images cannot be reproduced without our permission.
• Load times of our pages always take preference over graphics. Should we not be able to compress your photos to a size to enable efficient download times, we reserve the right to reduce the number of graphics allowable across an advert. We will tell you if this is the case.

2. Provision of Service

• Marsbrook will make every reasonable effort to maintain continuous online service, but does not warrant that the operation of any Marsbrook.com site will be uninterrupted or error-free.
• In no event shall Marsbrook be liable to the advertiser for any special, consequential, incidental or indirect damages, including lost profits, however caused, on any theory of liability

3. Limitation of Liability

• Marsbrook's liability for damages resulting from errors in any advertising that it publishes, or from its failure to publish any advertisement that it has agreed to publish shall be limited to the amount it actually received in consideration for its agreement to publish the advertisement in question. Marsbrook shall not be responsible for any special, incidental or consequential damages suffered by any party resulting from its errors or omissions. The Advertiser must report such errors or omissions within seven days of the publication dates

4. Advertisers Responsibilities

• The advertiser, must be the rightful owner of the craft or property, or acting on behalf of the owner, and is entitled to let and receive the profits of the charter or letting.
• Bookings and determination of client suitability are the sole responsibility of the advertiser. Marsbrook cannot be held responsible for any contract made between the advertiser and their clients.
• It is the advertiser's responsibility to obtain reproduction permission for all photographic and other material used in their advertisements. The advertiser warrants that they are the owner of the copyright in such material or is authorised by the owner thereof to grant to Marsbrook the rights therein contained. The advertiser indemnifies Marsbrook against any action brought for breach of copyright from the use of such material supplied by the advertiser
• Advertiser accepts all liability for the content of all advertising supplied by it. Advertiser warrants to Marsbrook that its copy is true
• Advertiser agrees to promptly advise Marsbrook of any changes in their personal contact details
• An advert relates to a single craft and cannot be substituted with a different craft.

5. Termination

• The advertisement will be placed for a term - typically 12 months. We will advise you when the advertisement commences (i.e. when it is live on the site) and when it terminates (one year less one day from advertisement commencement date).
• Either party can terminate the agreement on a breach of any clause of this agreement. If we are in breach, then we will refund the proportional amount of remaining time plus one month. If you are in breach we will remove your advert from the site immediately and no refund will be given.
• You can request that your advert be removed at any time, but if we have met the terms of this agreement then no refund will be given.

6. Payment

• Payment must be in Euros by Visa, Mastercard, or Switch, or by cheque drawn on a French bank account. We can accept payment into Marsbrook's French bank account from abroad and non French cheques in Euros, however, we are charged a handling fee for this and you will need to add approximately €20 to your payment. Exact amount to be confirmed at time of payment.
• All advertisements must be paid in advance and adverts will not be placed on the site until payment has been received.
